Waiver

Release, Waiver and Indemnification:

You will be required to agree to this waiver during checkout.

The undersigned participant (and his/her parent or legal guardian- if under the age of 18 years) does hereby execute this release, wavier and indemnification for him/her self and his/her heirs, successors, representatives and assigns, and hereby agrees and represents as follows:

To release Top Gear Motorcycle School Ltd., employees, agents, representatives and those governmental agencies and other organizations affiliated with this course, from any and all liability, loss, damage, costs, claims and/or causes of action, including but not limited to all bodily injuries and property damage arising out of participation in the motorcycle training course referred to above, it being specifically understood that said course includes the operation and use by the undersigned participant and others of motorcycles.

This indemnification shall include attorneys’ fees incurred in defending against any claim or judgment and incurred in negotiating any settlement. It is understood and agreed that the undersigned shall have the opportunity to consent to any such settlement, provided however, that such consent shall not be unreasonably withheld.

I HAVE CAREFULLY READ THIS RELEASE AND UNDERSTAND ITS CONTENTS

I recognize and understand the risk involved in learning to ride, and riding a motorcycle, and I acknowledged that risk by signing the Motorcycle Safety Waiver Form. I understand that my performance will be evaluated and that I must satisfactorily complete each training phase before advancing to the next level.

Excessive Damage to the motorcycle over $75.00 will by my responsibility. Should my instructor determine that I am a danger to my classmates, or myself, I will not be allowed to continue the course. I understand that this decision is for my safety and the safety of others and I will abide by the decision of my instructor. I acknowledge that if my lack of progress impedes or interferes with the class that I may not be allowed to continue the class.

To receive the Motorcycle Operator Training Course Completion Card, I must demonstrate competent motorcycle operation by attaining acceptable scores on the skill evaluation and the knowledge test. Failure of the knowledge test or the on-cycle evaluation, failure to appear for my scheduled class, or not satisfactorily completing a phase of the course is considered a failure for the entire course. There are no refunds for persons arriving late, failing or for dismissal from the course.

Note to the student: If you have physical limitations or are on medication, please be aware that this course is strenuous and physically demanding. If you have a heart condition, are prone to dizziness, or have a physical or mental condition, which may adversely affect your performance we advise against participation in class. You are responsible for your own decision to participate. If your condition adversely affects your performance, our instructors will ask you to leave the class.

All students are required to be on time for each class session. All students are expected to participate fully in each and every exercise and to follow the directions of the instructor. Tardiness, absence from any part of the course, or failure to follow the direction of the instructor may result in dismissal from the course.

 

The participant also grants permission and gives consent to Top Gear Motorcycle School Ltd for the use of photograph(s) or electronic media images for presentation under any legal use that may arise from your participation in the Training Course

The participant hereby agree to follow the rues and regulations of the program and that all information provided is true and correct.
